Straw Purchase

It is SO sad that a LEOW of an ATF agent that is in a group of LEOW's that I am on FB with doesn't know the definition of a straw purchase.

A LE wife is thinking of buying a gun for her husband so of course he's legal to buy one himself as a present for their wedding/anniversary, or something or nother. This LEOW of the ATF agent is telling her she cant' buy it because it's a straw purchase even as a gift because she's buying it for somebody else.

I'm not sure if she got this information from her hubby that is ATF or if she just made it up...

both, you will be amazed how much incorrect info ATF people pass on. I deal with FFL's from other states and they are telling we cant do what you are asking. Even when I provide them an ATF document outlining that it is legal to do what I asked, they say no, because local ATF told them it is illegal.

Actually I just went onto her FB page and she's not, but that's BS that they are telling people this. Sounds to me that they are all into the Obama administration..

Technically it is a straw purchase. The form ask if you are buying the gun for someone else.

Usually since your married with the same address we can make it work.

I get guns for the guys as gifts from their wives all the time. Just have to hold the paperwork and let the officer complete it himself.

The last one the wife had a CCW so she just bought it in her own name and gave it to him. A straw purchase but it'll be ok.

Can I suggest this article from ATF. Specifically this paragraph:

Where a person purchases a firearm
with the intent of making a gift of the
firearm to another person, the person
making the purchase is indeed the true
purchaser. There is no straw purchaser
in these instances. In the above example, if Mr. Jones had bought a firearm
with his own money to give to Mr. Smith
as a birthday present, Mr. Jones could
lawfully have completed Form 4473.
The use of gift certificates would also
not fall within the category of straw purchases. The person redeeming the gift
certificate would be the actual purchaser
of the firearm and would be properly
reflected as such in the dealer's records.

I'm gonna research this some. I've never seen that before. I've sat through boring hours of their babble coming away less informed than I was before I sat through their babble. ATF talks in riddles.

How about if u give me the money to buy u the gun,m then maybe then it is a straw purchase, for there is a reason why u cannot buy it yourself, but I think the ATF explanation makes alot of sense. NorAMALLY An illegal straw purchase, MONEY IS EXCHANGED..
