  • Ever have to show your CCW permit?

A couple of months back I asked the question: have you ever had to draw your firearm?

So recently in a MD shooters forum someone asked a similar but different question & the responses have been very interesting.

Have you ever had to show your CCW permit?

Most of the responses have been when someone was printing, or pulled over by LEO and volunteered they were carrying, or things like that. Of course there is little opportunity to carry in MD so almost all of these have been out of state. Wuz wondering what situations KahrTalk members have found themselves in?

I carried in Maryland, but never had to produce my permit. A couple of LEOs I routinely interacted with knew I had one, but never bothered to officially see it.

I'm now in Virginia, and in two encounters with LEOs, (traffic related), they haven't bothered to ask about the permit or my firearm, although that info appears on their computer screen when they check a plate.

The only time I've produced my permit is to purchase a gun, either from a FFL or at a private sale.
Judging by today's left wing, looks like Senator Joe McCarthy was right after all.

The law here in Texas used to require a Concealed Handgun Licensee (CHL) to present his CHL whenever an LEO asked for a DL. That requirement was eliminated a year or so back. My policy (and my wife's) is still to present both DL and CHL if/when I'm asked for ID by LE. I figure that it reduces the LEO's stress during the encounter which may make it end up better for me. He's going to know that I've got a CHL when he runs my DL anyway.

I've been in two traffic stops since I started carrying here in Texas about ten years ago, both with State troopers. One of them asked me to step out of the vehicle but leave the gun in my truck; the other just asked that I not touch the gun while we conducted our business.

And of course I produce it whenever I buy a gun so that I don't have to endure the NICS wait.

I don't routinely show it otherwise because it's none of peoples' business that I have a CHL.

That's about it, we do have do id if asked by a LEO, just not in the car anymore. I show it like that, and I work across the hall from a LEO, and have shown it to him just because he wanted to see it (I think his came up, and I commented that mine was older or some such). I had to show it once to get into the State Fair (yes it's legal and yes I did), and once inside which led to a story that I have told elsewhere here. I got stopped once, and when I showed it to the officer, he quickly and visibly changed his demeanor from guarded and wary to much less so and quite helpful and informative. Around here, it's no big deal. I've never been made to my knowledge, and those few that know I have it and use it might have seen it. I do carry that right behind my DL, and have used it when I needed a second picture id before. I also use it to save the gun store a phone call to NICS when I get to get a new one.

The olive branch is considered a symbol of peace, and good will. Last time I checked, it's still a switch.

I stand corrected; if we're carrying we still must present the CHL when asked for ID. It's only when we're not carrying that we're no longer required to produce the CHL when asked for ID, as of last September, IIRC..

Are you saying you don't go through NICS? I thought that the instant backgroung check was a federal requirement.

From the FBI's website, an excerpt of the description of NICS at http://www.fbi.gov/hq/cjisd/nics/nicsfact.htm

              "NICS Background Checks

The FFLs have the following three methods of performing background checks depending upon the state in which the FFL is conducting business:

              1. In states where the state government has agreed to serve as the POC for the system, the FFLs contact the NICS through the state POC for all firearm transfers. The state POC conducts the NICS check and determines whether or not the transfer would violate state or federal law.

              2. In states where the state government has declined to serve as a POC, the FFLs initiate a NICS background check by contacting the NICS Call Centers for all firearm transfers. The FBI conducts the NICS check and determines whether or not the transfer would violate state or federal law.

              3. Finally, in states where the state government has agreed to serve as a POC for handgun purchases but not for long gun purchases, the FFLs contact the NICS through the designated state POC for handgun transfers and the NICS Section for long gun transfers.

Each state decides whether the FFLs in its state call a state POC or the FBI to initiate firearm background checks."

I'm assuming that Texas fits under number 1 of the above three, meaning that it has agreed to perform the background checks on potential purchasers, and since a background check is a mandatory part of the process of Texas issuing a CHL, apparently that pre-CHL background check serves as the background check for NICS.

I just know that since I got my Texas CHL about ten years ago, I haven't had to undergo "the call", and I've bought guns from lots of FFLs across this state.

Actually, I had ignorantly assumed that all concealed carry licensees in all states were exempt from the call, but now I'm seeing that isn't the case.

I assumed all states made the call. Here in Virginia the NICS call is made with each purchase. The carry permit only allows more than one purchase per month, which is otherwise limited.

Here in Az. there is no call if you have a CCW when buying a gun. We do not have to show or inform LEO unless they ask you.

I`ve had to present mine 3 times here in NC. State law is that if you are confronted by a LEO you must inform him that you have a CHP if you have a handgun with or on you.If you`re not carrying, you don`t have to inform. All 3 of my encounters have been at license check points. Two of the LEOs were pretty cool about it but one was a horse`s ass.You would of thought that I had threatened him rather than merely informing him.He was so antsy that I asked him to call another officer over.Fortunately his sgt.was there and all went smoothly after that. What a tool.
In the area in which I now reside, when I`m placed in a group of four or five guys,I`m known as "the smart one".God help me.

I never had that problem, and now that I think about it, when I lived in NC I had the pleasure of a check point just once. Kinda surprising seeing as how they know they can usually nail a few Marines around the bases.

I've only been stopped a few times in the last 23 plus years... 21 years or so, no ticket, then stopped in Kentucky 2 or 3 years ago for speeding 77/70. The officer was more concerned if I was LE, because I had a Florida Sheriffs' Association Youth Ranch license plate. He asked me at least 3 times if I was sure I wasn't LE. I'm an honorary member of the FL Sheriffs' Association(I support them with donations for the Youth Ranch and the Association), but on the back of the member's ID card is a pledge to not produce that card at traffic stops and the last thing I want to do is represent myself as LE... I think that's illegal... and embarrassing or worse if asked to produce a badge!
Anyhow, he didn't ask and I didn't tell. If I were ever asked to get out of the car, I would definitely bring the permit up and that I was legally carrying. That just seems the smart and safe thing to do. Of course, you risk getting a horse's ass who reacts as if you had just popped up on his laptop as an armed and dangerous felon! Unfortunately, there are cops like that. I'm always respectful and polite, and I expect them to be the same... so far I haven't run into one of the H.A.'s.
Here in Florida, our legislature, by error of omission OR intent, didn't exempt Concealed Permit Holders from the Federal NICS, so it costs us at least $5 extra to buy a gun, though we don't have to wait for anything other than an answer from the NICS.

My cop buddy who used to live behind me, didn't ask, but took my word and said he was glad to have the backup on at least one occasion where I heard a commotion and went and stayed in the bushes out of sight, but ready to help....
It was at night after park hours and an irate husband was chasing his wife's boyfriend in the park behind my house with serious a$$-kicking in mind... I guess. The wife and the boyfriend were hollering and the boyfriend ran up the hill to the cop's mobile home, which is within 10 yards of my back fence... which has a gate onto the park. My buddy came out in his boxers... evidently unarmed, so I just waited to see if he needed help. It could have been dangerous for all concerned, but I guess the husband was unarmed and backed off. I told the cop a few days later and he seemed grateful.
I helped him watch over the park, and opened and closed it while he was away or on duty. He gave me instructions about trespassers and what to do. I felt a lot better being armed while doing so, but I didn't let it go to my head.
You just never knew what you were going to run into in that little neighborhood city boat ramp/park... even with the gate locked.
Before the city set up an on-site cop, I had been helping the unpaid caretaker of the park with opening and closing... I had a key and he let me know when he couldn't take care of the park. Being it was almost my backyard, I had a vested interest in keeping things under control back there.

Showed it yesterday for the first time....Now before I get started let me say that I respect and support police officers and I obey the law...I am a retired former Firefighter and have known and worked with many Police Officers and just like any profession there are some really good guys and gals on the job and a few HA's...Well that said, yesterday I ran into the latter...My son wanted to pick up a game at a video game shop in the Wally World shopping center....There was no place to park anywhere so I told my son to run in and get back out quick and I would wait at the curb....I'm sitting there with the motor running and A/C on listening to the football game on the radio....About 30 seconds after I was sitting there I noticed a Chamblee Police car behind me...I turned off the truck and rolled down my window thinking he was going to tell me to move but nooooooo...I didn't have my pistol on me but my 1911 truck gun was in the console so I gave him both my CCP and drivers license...He did a full FBI, NCIC backround check on me for 20 minutes before coming back to the truck with my $75.00 parking ticket...The guy was very rude even though I didn't argue at all because technically he was correct but come on....This Wally World is in Chamblee Ga. AKA little Mexico and at any given time there are at least 1000 illegal aliens walking around and Super Trooper is busting my ba!!s for sitting in a no park zone!!!....The Police don't mess with the Mexicans at all and prey on citizens like me....Now I'm going to pay the ticket (first one of any kind in over 25 years) and be done with it but it leaves a bitter pill in my gut....Here in Metro Atlanta there are many small Police Depts that only exist for speed traps and tickets to pad city hall...The county Police do an good job and there is really no need for the small city forces who's sole purpose is for Tax Collection and Tax collection only....I'll get off my soap box now...

Well, at least you didn't get one of those real AH's who orders you out of the car and treats you like he's just stopped and caught the FBI's most wanted... because you gave him your CCP up front. I've certainly heard stories like that.
I hope you've learned your lesson and have given up your life of crime after this incident. You might have taken up his time when there was something more important going on... life or death... instead of increasing the city's revenue.

I'll chip in if we want to take up a collection to pay getsomes fine. I'm sure it was a crime of passion, his mind wasn't right being focused on football and all.
Working with the boys in blue everyday I can attest that there are both varieties of officers. We have mostly good ones but some occasionally swing towards the bad side.
We're facing layoff and shortages and the city council says the police dept is the biggest burden on the budget. Duh. I advised that the Police Dept is not and shouldnt be a money making organization. I'd like to see the fellas stop every city councilman/woman everytime they see them and cite them for something. If you follow long enough they can always find something.
PM me an address and my 20 bucks will help the cause.
For awhile I carried a tube of preparation H just for those guys, figured I'd offer it to them after I got my ticket. Never happened probably luckily for me.
