    So. How does that work for someone who can't speak and doesn't happen to have a pencil or paper on hand. Guess they are screwed.

    What a bunch of freakin' idiots. SCOTUS has descended into utter stupidity. They haven't a clue what the Constitution means.

      Oh, they do... It means an extravagant lifestyle until they retire and lots of jobs for lawyers and interns and such.

        I am not sure why the hubbub about this. You have to evoke your right otherwise a conversation with a LEO will ensue. Just as a LEO has to ask to search your person and you have to say yes or no. So...??? The right(s) (4th and 5th) is/are there all the time. You pick and chose when you want to be protected by it. Isnt that what freedom is? Sounds good to me.

          knkali, if that were the case, then what's the point of the Miranda law and reading someone their rights? you have the right to remain silent...not, you must notify us that you are exercising your right to remain silent. I understand the Miranda law is not the Constitution, but the Constitution is pretty clear. The assumption by government/police/jury MUST be that silence has no bearing on innocence or guilt, otherwise the system falls apart. using your silence to garner/justify court testimony or a guilty verdict? really?

          Does this carry to the other 10 amendments in the bill of rights. do I now have to notify the government that I have a right to free speech before I speak, of freedom of religion as I walk thru the door of a church, notify them that I am buying a gun?
