        I would think that they can allow the jury to consider manslaughter as a lesser offense as long as he was initially charged with manslaughter as well.

        Adding charges now, simply to allow them to be added to the crime(s) being tried for would, in my opinion, be illegal.

        I've seen many cases before where someone was being tried for 1st degree murder, 2nd degree murder, manslaughter, etc... but all charges were known at the beginning of the trial.... never seen the issue come up at this point in the trial.

          It probably would have went with a general charge of Criminal Homicide. Commonwealth has the burden to prove what type of homicide it was. Being it wasn't premeditated or in commission of say a robbery, then it would be 3rd Degree if found guilty. Voluntary or Involuntary Manslaughter..
