As long as the filmer is in a place they have a legal right to be and are open and obvious about what they are doing I see no issue. HOWEVER if the filmer is acting in a furtive manner, aka hiding behind the bushes attemtping to disguise or hide thier actions then tough rocks. One of the indicators of potential illegal behavor is the person acting in a manner different from the regular ordinary citizens in the area at that time.

Anybody who attempts to hide there actions will draw interest from citizens and PD alike. Once a citizen calls in then the PD has every legal authority to investigate to their satisfaction.
