While many condemned Chief Justice John Roberts for declaring that the fine for failing to sign up for Obamacare is a tax and declaring the law constitutional on that basis, Justice Roberts opened the door for another lawsuit to have Obamacare ruled unconstitutional based on the fact that the constitution states that all tax bills must be initiated in the House of Representatives. The "Tax" in the Obamacare bill was initiated and passed in the Senate without house approval. On this basis the law is unconstitutional. A cased based on the tax ruling will be brought before the supreme court prior to the next election. Obamacare could fall like a house of cards with the senate democrats hoist on their own petards. (That means screwed by their own dicks, Jocko.)

I think Muggsy is smokin' some Colorado poke salad if he thinks 0-care will vanish because it originated in the wrong legislative body. If the fee vs. tax question wasn't enough to kill it, a technicality like this won't mean jack sheet.
Good luck voting the permanent noblemen out of office, too. Those politicians cost someone way too much money to just let them get voted out.

John you are entitled to your opinion no matter how wrong it may be. The Senate initiating a tax bill is in direct violation of the constitution and the separation of powers. George Will and I must have shared a joint.

I'm not disagreeing about who is allowed to initiate a tax bill, I'm disagreeing that the law will be overturned because of that, or any other legal argument. I think we're at a point where the only way to make it go away is for Congress to repeal it.

+1 JohnR. I tried to sue City Hall once and learned the hard way what that old saying means. They don't have to follow the law...but you do...every step of they way. City Hall will find a way to manipulate the rules to their favor. Right and wrong have nothing to do with it.O|||||||O

Aww come on guys, don't piss in my Wheaties, and say they can't kill this bill for originating in the wrong branch of Congress. I have visions of Hope and Change, and not the ones Odummy was talking about.Tom

It's unconstitutional for so many reasons, one more doesn't matter. It's not going anywhere. Congress will not repeal it because they know Obama will stick to his guns for the next two years. Even taking the Senate and retaining the house, I really don't think they'd get enough votes to override the veto.
Two outcomes at this point.
1. They tweak the crap out of it, turning into a gov't program for the moochers and leave the rest of us holding the bill. And the rest of us will be left with the 'tweaked' law that lets us out of the gov't side of it, still having to pay for insurance ourselves, but w/ higher taxes to cover the moocher class.
2. It collapses under its own weight and they push thru single payer w/ the Dems and Rinos left after the shellacking they are going to get this fall.
Just don't see enough conservative (true conservative) wins coming this fall to accomplish a full repeal and replacement.
I've been known to be wrong, but not often.

FuukknA....wait until 2016 when the risk corridors written into the law come to an "end". You will see how it is gonna cost more and more....Originally posted by chrish View PostIt's unconstitutional for so many reasons, one more doesn't matter. It's not going anywhere. read this then you decide. I think it will be a bail out but you can call it what you want. Insurance companies will win no matter what. We will pay. It is that simple. Unless a lot of healthy young people sign up, the ACA will implode--the math never lies. http://www.forbes.com/sites/theapoth...t-of-insurers/I am the Living Man

Even The Blaze and Fox news said there are past tax bills initiated by the Senate, and they stood. Maybe because nobody wanted to fight?
My friend Andy took on City Hall and won. His was regarding decorative lighting visible from the intercoastal waterway in Pompano Fl. The law stated that property along designated waterways must be kept free from colored lights that can be seen from a certain distance upon the water. White lights excepted.
Andy's lawyers argued that the Intercoastal was not a designated waterway, and asked the City to show the court where such a designation existed. The City wanted to reschedule the court date. Andy's lawyers contended that this was disallowable, it was the City's burdon, their day in court, to propove the guilt, and that he'd sue each City lawyer individually and personally if they continued to pursue the case. The judge was helpless, and took recess stating that he'd give a decision at a later date. Andy's ex wife has been living in that house on the water for about... oh.... 45 years since the court case. The judge isn't even alive any more, and no decision was ever given. Chalk one "draw" up for the good guys.
