  • The Greater Danger

    As I see it, certainly danger lies in electing the wrong President and that would put the country in grave peril for the next eight years at the most. The greater danger lies in who the wrong President puts on the Supreme Court. The Court today, is 50/50 conservative and liberal Justices. These Justices serve a lifetime or until they decide to retire. Their interpretation of the Constitution is binding on all of us. I believe liberal Justices are secretly not supporters of the Second Amendment and we all could be affected by their decisions for generations to come. I say there should be term limits on how long a Justice could serve on the Supreme Court no different from how long other politicians can serve. Should a Justice continue serving on the Court as their brain begins to atrophy? Would you trust your doctor to operate on you under the same circumstances? Of course not. Since it would take a Constitutional Amendment to change the tenure of a Supreme Court Justice, the best we can do for now is to elect the right President. This is how I see it, so what say you?

    Supreme court justices can be removed by Congress. For example, if they were not following the constitution in their rulings, they would be guilty of a crime under the constitution and they could be impeached.

      Given that statement the Congress SHOULD have proceeded as recently they did NOT interpret they WROTE laws. A complete failure....

        SCOTUS shouldn't interpret anything. They should look at the facts then apply the letter of our Constitution and Bill of Rights. Political affiliation should not be a factor. Naive sure but that's my Utopia.

          Exactly. If our congressmen did their jobs as they are supposed to we wouldn't be in this mess nearly as deeply as we are. I am beginning to see our congress as professional wrestlers. When the public show of fighting is over they get together privately and laugh at us. People are fed up and without taking a chance on a major change we've had it.

            If it's written that the Congress can impeach a sitting Justice of the Supreme Court, then Congress has NOT been doing it's job as Chief Justice Roberts is still there. Roberts' vote was the deciding vote on whether or not the Affordable Care Act (Obama Care) was legal. Congress should have put a stop to Obama's Executive Privilege ploys by cutting the purse strings but they didn't. There is a vast chasm between what should rightfully be done and what is actually done in the Federal government. Once they are elected and live in the Federal Bubble, the whole world looks different. Why is the populace voting for a real estate billionaire who has never held office when there were plenty of professional politicians also in the race for the Presidency? The people have had it with Washington!

                I respectfully disagree.....

                I am not 100% behind term limits on the SC judges for a few reasons.

                Article 3 of the constitution states: ...judges shall hold their office during good behavior.... Because a judge makes a decision we do not agree with doesn't mean that they are exhibiting "bad" behavior. Cannot please 100% of the people 100% of the time--right?

                A president nominates a SC judge BUT congress has to ratify that nomination. There is one of the checks that our system of gov has put into place to keep the SC as bipartisan as possible.

                If we put term limits on SC judges, we are going to politicize an office more than it should ever be. A more Partisan SC is NOT what we want. Corruption of the SC will be more than what you think it is now.

                We have more than one judge in the SC, this further reduces the influence of any one decision. A buffer for the older judges that might not be perceived as sharp as the younger ones.

                With a long term judge, one can make the argument that with time comes experience, and with a long term position such as a SC judge, any ties with a political side will erode away. There is no reason for a judge to maintain it.

                Please tell me why I should change my views here. I am open the possibility that I am jacked up thinking this way.

                  While I did solicit your input and respect it, it was not my intent to change anyone's views on the process used in the selection of Supreme Court Justices. The gist of my post was to express the dangers to gun owners should a liberal President be elected this November and begins nominating anti-gun nominees to the Supreme Court. If conservatives lose the majority in the Senate, I can see these nominees being seated and once seated, will be there for a long, long time. I would not like to see Senators Diane Feinstein and Chuck Schumer fill future vacancies on that court. I sleep much better when conservatives hold the balance of power in this country. I've seen how liberals govern.
