If he didn't get the shots off before the guy started running, his friend would likely be in jail. The BG was no longer a threat when he was fleeing. You really can't make a case of self defense when you shoot someone in the back. I recommend to anyone who conceals a firearm that they read the book "In the Gravest Extreme" It covers a lot of things most people wouldn't think about. Like shooting someone in the back when the threat is no longer there, or pursuing after the BG after he flees. Neither of which are things you should do.

I was thinking more of...if the BG had not turned and ran but stayed put and was still presenting a threat. I can definitely see problems arrive if the BG turned and ran and you tried pumping a few more in him or either you chased him shooting more.

UPDATE

I got my CM9 back from him yesterday!

Local police department has been slow getting his gun processed due to a backlog, but he should be getting his back within the week or so.

And someone in his family is loaning him a compact carry piece until then.

Good to have my Kahr back on me.

His gun wasn't used in a crime.
