    I really, REALLY want to believe this. However, if past experience is any guide, I would bet heavy that the establishment Republican politicians in the Senate are going to, by and large, roll over and get their tummies rubbed by special interest groups/lobbyists.

    The system is broken.

      We better watch out. "O" may try and use his pen if he can figure out how. I know that's not how it works but if he can find a loop hold we better watch out. I bet he has his "lawyers" looking into it now.

      If I recall he did some federal district judges that way.
      The only thing better than having all the guns and ammo you'd ever need would be being able to shoot it all off the back porch.

        Opuke could make a recess appointment without Senate confirmation, if the Senate is in recess. It's been done before. So don't go on recess until the next innauguration day.

          What is left of The America we love, may have died as well today, along with Justice Scalia. depending on his replacement. I don't trust McConnell and his RINO buddies to do much of anything to help conservatives. Another liberal on the court could well mean the end of everything that is Godly, decent, moral, or conservative.

          I'm sure Obama will waste no time nominating the most liberal replacement he can find. He's been dreaming of this opportunity since he weaseled his way into the White House. He wants to leave some kind of legacy, and this is his chance.
          Perhaps they can drag out the confirmation hearings for several months, and then vote to not confirm then vote not to confirm the nominee, and repeat the process until after the elections, and swearing in of a new president who may be able to withdraw the nomination and make one of his own. Otherwise we are in deep dung. What really gets me is they way they appear to be able to write legislation from the Bench. They strike down anti gay marriage laws, and states just start issuing licenses for gays, without any new laws being written. Writing laws is the job of Congress and the State Legislatures, not the courts. The courts are there to rule on whether they violate the constitution or not, and not to MAKE law. This whole system is out of whack already. I hate to see what could happen if Obama gets his way.
          I don't know if people realize the gravity of the situation here. I think most of us do but as for the average conservative, who knows? This could lead to some very severe actions and reactions. Things that none of us want to see happen.

            Can you say recess appointment? If the Senate goes into recess Obama can appoint whom ever he chooses to the SupremeCourt without the need of senate conformation.

              Im not sure but I don't think he can make a recess appointment to the Supreme Court. Only the lower courts.

                Muggsy, there hasn't been a successful recess appointment to the Supreme Court in 60 years. Even if Obama wanted to fill the vacancy in this manner, he has a week to do so before the Senate returns. He could never make a credible argument that a week-long Senate recess created an emergency that justified a recess appointment. The move would appear so blatantly, politically motivated--especially in an election year--that it could result in the political homicide of democrats running for re-election at all levels of government. Obama's own party will oppose recess appointment, because in the end politicians are more concerned about their own re-election than anything else.

                Obama knows a Republican-controlled Senate will never confirm a Supreme Court nominee as long as he is in office. That is exactly why he will embark in the dragged-out, highly publicized "illusion" of attempting to fill the vacancy. With less than a snowball's chance of confirmation, Obama will submit a nomination, knowing full well that it will fail, but doing so to discredit Republicans who will vehemently oppose the nomination. The confirmation process will be hotly debated, broadcast on all networks for months on end, dragged-on until elections, with the sole purpose of making Republicans appear to be a contentious party that impedes progress of our nation.

                ...and the Republicans are already taking the bait.

                  Theoretically yes. And he's abused that along with every other presidential power. But the Supreme Court put a stop to it and held a couple of years ago that the Senate gets to declare whether they're in "recess". All they have to do during a lull is make sure that somebody comes in at least once every couple of days and does some minor legislative stuff, and it's not a recess.

                    With the current make-up of the Supreme Court the court could rule that a recess appointment was necessary. Do you trust Ginsberg or Sotomayor to side with the republicans on the ruling? I sure as hell don't.
