    My inquiry may have been missed along the way. I know in this case (likely most cases) the first shot was without sighting. Given the answer I received from the OP it's obvious the perp rolled behind cover then ran.

    The opportunity to ask questions of an incident that happened in these conditions doesn't happen often and my question was in regard to any followup aiming toward the perp after the first shot. It was only if he considered night sights useful in this particular situation for followup sighting.

    The reason is everybody seems to know down to the fly specks exactly what they will do in a situation. But of course most of that goes out the window when the shotgun is stuck in their face. Just having night sights does not mean you will actually use them, so I wanted to find out if they were used in this case. Next will come I'd rather have them and not use them than not have them when I need them. I'll agree with that also, but that wasn't my question. Again, were they actually used in this particular situation. However, I don't think I care any more. I'll take it that he didn't hold sights on target and let it go.

      Just got home from spending a couple of hours with my friend.

      He's doing well, but they took his gun until the investigation is complete.

      So what does a good friend do?

      I loaned him my CM9.

      He said he not only didn't use his sights, he doesn't remember any loud noise or recoil.

      He swept the shotgun muzzle away with his left hand, drew and fired across his lap with his right.

      The perp saw the gun as he drew and began to step backwards.

      When he fired the perp was moving/falling towards the rear of the truck.

      It don't work like in the movies, friends.

        Wow, good for them. It's irritating that in many places (apparently) some dirtbag perp's dirtbag lawyer can have your personal property more or less indefinitely confiscated, when all you did was legally defend yourself with it.

          It is called Auditory Exclusion and is one of several well documented physical reactions to a use of deadly force incident. There are others.

          Bimmer as a furtherance if the DA does charge you then you are found not-guilty the plaintiffs bar will have its bite at you and then the weapon can be held pretty much until the entire appelate civil case is concluded. Can you say a decade or more.

                      Time have never been "good" in Beaumont, but things sure do seem to have gotten worse over the last 40+ years... I sure am glad the good guys came through clean on this one!

                                If he didn't get the shots off before the guy started running, his friend would likely be in jail. The BG was no longer a threat when he was fleeing. You really can't make a case of self defense when you shoot someone in the back. I recommend to anyone who conceals a firearm that they read the book "In the Gravest Extreme" It covers a lot of things most people wouldn't think about. Like shooting someone in the back when the threat is no longer there, or pursuing after the BG after he flees. Neither of which are things you should do.
