And I am well aware of the use of force continuum. And I am aware that each state has its own laws. Being involved in a fist fight here doesn't allow you too shoot someone because you are loosing. Not saying that is the case, just trying to show differences in laws.

I would like your view of this scenario:

You are walking down the street and some guy approx 28 years old for some unbeknownst reason to you has a problem with you. You try to avoid him and or talk him down but he suddenly then starts swinging at you. Would you draw your weapon and possibly pull on him or stay with fists or take a beating and hope your insurance and doctors can put you back together if you don't die from the assault. BTW you cannot outrun this young man.

I am not tryi9ng to be flippant here. I really would like to get your input on this given your previous experiences esp as a LEO.

Myself, I would draw my weapon and keep it at the low ready position, and warn him. But here's where it gets tricky. If I point it at him and the DA decides your actions were not warranted in the situation, you can be charged criminally. Even in clear cut deadly force situations here, people have had to sit and wait for the DA to make a decision. That's PA state law for you. Now if someone drew a weapon, then I'm gonna do what I need to do to protect myself and others. No warning!! Oh I can honestly say things live this have happened to me (threats to beat my ass etc) I told said person here I am if that's what you need to do lets do this. Sometimes a little "verbal judo" goes a long way..

Thanks Swilcher. I needed to get a feel for what others would do to gauge my response. Verbal judo is never part of my lexicon. I never want to do anything to escalate but I understand your position on that matter clearly.

I'm too old to fight, too crippled to run, but I can still do five pound curls with my index finger. Does that answer your question?

There is only one law in this situation and that's the law of the jungle. Kill or be killed. If your gun clears your holster you had better be prepared to use it. Your attacker won't hesitate to use his.
